CMS Issues Final Ruling for CoP Compliance

CMS just issued the Final Rule setting out an new effective date for CoP compliance (link).  As proposed, the new compliance deadline is January 13, 2018.  CMS chose not to delay the effective date to make them align with issuance of the interpretive guidelines.  CMS anticipates an issuance of draft guidelines this Fall with finalization in December.  CMS expressed that the regulations can be implemented without the guidelines.

 

CMS also did not address the issue of transitioning subunits to parent HHAs or branches, indicating that such process was not germane to the CoP rule and that the appropriate CMS division has been alerted to the concerns.

 

NAHC shared its appreciation of CMS’ change in the CoP rule effective date, and will continue to address the subunit transition issue with CMS Provider Enrollment staff in hopes of getting a simple transition process.

 

The Final Rule explains that CMS expects flexibility by surveyors reviewing compliance. It is hoped that such flexibility extends to the new CoP rule as a whole given the absence of final interpretive guidance presently.
